What expires on 9 November 2026
Every Section 301 exclusion still in force lapses for goods entered after 11:59pm ET on 9 November 2026. There are 179 of them, covering 169 distinct 10-digit codes across 78 headings. No process is open to request a new one, and USTR has not said whether it will extend these.
Why most affected importers will not know. An exclusion is claimed by your customs broker against a tariff-schedule note subdivision — not by product name. What you see is a duty rate. What changes on 9 November is that rate, on entries after that date, with no process open to apply for a replacement.
Where these come from
Extracted directly from the tariff schedule itself — USITC Harmonized Tariff Schedule, Chapter 99 (subchapter III, U.S. note 20), captured 2026-09-10 — not from a press release or a secondary tracker.
| Tariff heading | U.S. note | Effective from | Lapses | Exclusions |
|---|---|---|---|---|
| 9903.88.69 | 20(vvv) | 2024-06-15 | 2026-11-09 | 164 |
| 9903.88.70 | 20(www) | 2024-01-01 | 2026-11-09 | 15 |
⚠ A one-item discrepancy, stated rather than smoothed over. The tariff schedule enumerates 179 exclusions across these two notes. USTR's November 2025 press release announcing the extension said 178. We publish what the schedule says, with the source, and flag the gap. If you are relying on this, check your own line against the note text.
Check your own entries, free
If you are the importer of record, you can find the entries that rely on one of these exclusions yourself. In the ACE Portal, run ES-003 — Entry Summary Line Tariff Details. It breaks each entry summary into its tariff lines, so the Chapter 99 numbers claimed on each line appear in it. A line that claimed 9903.88.69 or 9903.88.70 relied on an exclusion listed on this page.
It needs an ACE Portal account and costs nothing. Your customs broker filed those entries and can tell you the same.
Is your code on the list?
Type an HTS code — 8 or 10 digits, dots optional. This runs entirely in your browser; nothing you type is sent anywhere. It checks the 179 exclusions on this page and nothing else: not the other Section 301 or Section 232 actions on the same line, and not whether your goods are the product described.
What comes back when they lapse
Each exclusion suspends the additional duty of one Section 301 list heading. The sub-part of the note that lists it names the heading, and the schedule's own operative text gives the rate for that heading.
| Heading whose duty is suspended | Section 301 list | Applies again at | Exclusions |
|---|---|---|---|
| 9903.88.01 | List 1 | +25% | 47 |
| 9903.88.02 | List 2 | +25% | 37 |
| 9903.88.03 or 9903.88.04 | List 3 | +25% | 70 |
| 9903.88.15 | List 4A | +7.5% | 25 |
Has this happened before?
Yes — 7 times for this set of exclusions since its 2022 reinstatement. What the record shows is the timing: 3 of those notices were published in the Federal Register after the date the exclusions were due to lapse. The announcement has not reliably arrived in time to plan around.

An extension is not always whole. In 2024 there were 429 current exclusions (FR 2024-11904). The schedule's heading 9903.88.69, effective 15 June 2024, carries 164 of them. The rest lapsed after a 14-day transition.
Dates are Federal Register publication dates. USTR sometimes announces by press release before publication; those dates are not used here. This is a record of what happened, not a forecast of what USTR will do next.

Headings affected
If you import under any of these four-digit headings, at least one expiring exclusion cites a code within it. That is a reason to check — not a finding that you are covered.

An exclusion's scope is governed by its product description, not by the HTS number alone. Several exclusions cite different statistical reporting numbers for different date ranges. Whether a given shipment is covered is a question for a customs broker and trade counsel; this extract states which exclusions exist and when they lapse, nothing more.
What you can actually do about it
- Find out whether any of your lines is covered — the descriptions above and the CSV are what your broker needs to check.
- Quantify it — the rate that applies again is in the table above. Multiply it by your import value for entries after 9 November.
- Act while there is still time — forward-buying, contract re-pricing and supplier requalification all take longer than the days remaining.
If you want this worked out line by line for your own imports — the rate that comes back, the dollar figure at your values, and every other action already on the same line — that is the November 10 Brief. If ES-003 and this list answer your question, you do not need it.
